LEGISLATOR'S INTENTION AND MEANING OF ORDINARY LAW IN THE JURISPRUDENCE OF THE ITALIAN CONSTITUTIONAL COURT

The paper takes into account the role assigned to legislator's intention by the Italian constitutional Court. It is shown how, through an analysis of the interpretative criteria of 'respect to the living law's norm' and 'interpretation in accordance with constitution', as well as through their contrast with the case law about authentic interpretation, it works out that the role of legislator's intention -from the perspective of its actuality- must be seen as a central one.
