Celerity Access To Genetic Resources and Associated Traditional Knowledge: Mechanisms Adopted in National Regulation

摘要
The access of the genetic resources and traditional knowledge associated in Brazil, is regulated by the Provisional Law2.186-16/01 The provisional nature of legislation remains for more than ten years, and there is not any prediction for a final definitive law. The Genetic Heritage Management Council (CGEN), created by Provisional Law was initially the unique body responsible for analysis and issue licenses for access and collection of all natural heritage and its associated knowledge. This centralization has generated several difficulties for issuing such licenses. In an attempt to make the process more quickly, the CGEN gave credentials several institutions, delegating to the mauthorization to issue licenses. These institutes were the Brazilian Institute for the Environment and Renewable Natural Resources (IBAMA), the Chico Mendes Institute for the Biodiversity Conservation (ICMBio), the National Council for Scientific and Technological Development (CNPq) and the Institute of Historical and Artistic Heritage (IPHAN), showing a decentralization not only to several organs, but for various state departments, which necessarily will have to work in harmony so that the objectives of such decentralization are achieved.
