The influence of the UNIDROIT Principles of international commercial contracts on national laws

摘要
The UNIDROIT Principles of International Commercial Contracts are intended to serve various purposes. The article focuses on the use of the UNIDROIT Principles as a source if inspiration for domestic legislators. It shows that legislators have used the UNIDROIT Principles in widely differing ways, including everything from citing them as a means of corroborating the suitability or current validity of one or another rule or law, to copying out entire chapters word by word. Although the UNIDROIT Principles were never intended to unify general contract law, they offer a common language for use in matters relating to contract law. As a consequence, the UNIDROIT Principles invite domestic legislators to be mindful of the evolving lines of international legal thought and are conducive to a spontaneous harmonisation of domestic contract laws.
