The article aims to discuss a historical analysis which explains the arduous and slow path taken by society for centuries, to achieve a position of respect for women's rights; thoughnot can be consider the aforementioned respect as real achievements, but only and only a simple safeguard manifestation human right, the events that have marked the world stage should be reminded constantly, given its relevance, since resulting changes in current legislation in the country which are to underpin safeguard the principle of human dignity and nondiscrimination, arising from an age-old struggle, which was to involve suffering and revolt, the prejudice faced, in our times are nominating as being gender equality. Although it is protective approach of international nature, since recognized in various international agreements, as a human right, it can be seen that in Brazil took a little longer to expropriate the legislation, such as the Civil Code of 2002 and the code of Civil procedure, 2015; however, these although they represent exhaustive protection of women's rights, the effectiveness is a factor that still needs much improvement to be sought by social awareness.
