THE NEW ISRAELI ANTI-DUMPING LEGISLATION: ONE MORE MODEST STEP IN ISRAEL'S GRADUAL ADVANCE FROM UNILATERALISM TOWARDS TRANS-NATIONAL CO-OPERATION

On 27 June 2005, the Knesset, the Israeli Parliament, adopted an amendment to the 1991 Trade Levies Law, thereby providing, inter alia, for a new Anti-Dumping regime. The declared ratio legis of the new regime is to bring the Israeli Anti-Dumping legislation in line with Israel's international obligations under the GATT/WTO. This Article argues that despite some shortcomings, the new Anti-Dumping legislation is praiseworthy for bringing Israel into conformity with its multilateral obligations and for tempering the protectionist potential of the Israeli Anti-Dumping regime. The Article further contends that the new Anti-Dumping legislation must be examined in its wider context, namely Israel's gradual advance from unilateralism towards a more co-operative approach in international relations, in general, and in the spheres of international organizations and international norms, in particular. The new Anti-Dumping legislation may be seen as one more modest step in that direction.
