ETHICAL-JURIDICAL PROBLEMS IN RELATION TO DRUG ABUSE DURING PREGNANCY

摘要
Drug abuse in pregnancy supposes a objective situation that place the fetus at risk of harm and difficultly can be justified from a perspective based only on the freedom of the pregnant woman. From an ethical-juridical analysis it seems reasonable to establish a prevention policy to ensure that the best interests of the embrio-fetus are served. The freedom of decision supposes the capacity to assume risks of personal character but it should not suppose the possibility to impose those risks to third people and even more when they are unable to choose.
