THE STATE OF CRIME AMONG PROBATIONERS: FEDERAL AND REGIONAL ASPECTS

The authors examine the criminal behavior of persons who received a conditional sentence. A conditional sentence is determined as a criminal law measure awarded by the court to a person found guilty of a crime, when the main penalty awarded for this crime is correctional work, limitations in military service, placement in disciplinary military barracks or deprivation of liberty for up to eight years; the court rules that the execution of this penalty is conditional for the period of probation on the condition that the convict proves his correction by his good behavior. Experience shows that the majority of probationers commit crimes during their probation period. They can be called the crimes of probationers. The paper argues for the necessity of using the concept of "penal crime", which is partially comprised by crimes of probationers. The status of crime among probationers is analyzed in the federal and the regional (using the example of the Republic of Mordovia) aspects. The authors studied these crimes for the period of 2008-2015 and revealed the patterns in their dynamics. They conclude that the number of conditional sentences went down both in the Russian Federation as a whole and in the Republic of Mordovia due to the reduction of the general number of crimes registered in the country and in the region as well as the changes in criminal legislation. The authors also identify specific offences for which the courts use Art. 73 of the CC of the RF most often. They describe the offences constituting the core of crimes among probationers in the Republic of Mordovia.
