摘要：
Theoretical reflections and practical considerations in reference to the eficiency of "mediation" for conflict resolution in Ski Case Law are presented. The evaluation and assessment of negligence to determine responsibility is the main objective. General considerations about the formulation of blame/negligence in Roman Law are brought up.
