摘要：

this study analyses the so called criminal liability of juristic persons in Roman Law with the intent of questioning the origins of the doctrine expressed in the Latin phrase societas delinquere non potest. From World War II to the present, the attribution of this doctrine to Roman Law has invested with an alleged authority those opinions within criminal law stating that corporations cannot commit crimes.
