摘要
The goal of the text is to reveal the latent theory of recognition in Kant's legal philosophy, which enables the division between potential social contract candidates and entities which are not part of the moral order. Furthermore, the text reveals the difficulties that arise from the intertwined nature of Kant's moral and legal philosophy. This is best seen in the case of the criminal of conscience, who reveals the problems Kant's moral and legal philosophy has with differentiating difference from antagonism of world views. Kant's moral and legal philosophy which raises arbitrary social institutions to the status of universality, reveals itself to be inapt as a tool for mediating conflicts between different cultures and world views.
