摘要：
This article analyzes the horizontal efficacy of the fundamental rights and its application in Brazilian constitutional order among the Supreme Court's position on the subject. With this purpose, it runs through the following path: introductorily, it covers the basic subjects of the fundamental rights' theory. Secondly, it decomposes the horizontal effect of these rights under the mantle of different explaining theories. Getting over this stage, it is proven that the Brazilian Supreme Court adopts the theory of the direct efficacy (unmittelbare Drittwirkung). Finally, it's concluded that the mentioned model is appropriate as it fits to the cultural, economic and social aspects of the Brazilian reality.
