The judiciary in Brazil has been one of the main institutions that deserves the most severe criticism, whether by society, whether on the side of intellectuals and even its members. The slowness of justice facilities and all the material difficulties are revealing only of the less problematic parts of the situation of the judiciary. In fact, the central concern is the democratization of the judiciary, in its transformation to become an instrument of democracy and the transparency, not an autonomous bureaucratic status of the state itself. The text faces this discussion for the establishment of the so-called democratic culture within the judiciary and its impact on its structural change.
