New Places for Constitutionalism

The constitutionalism's success as a tool to understand and organise our political realities following principles universally recognised as legitimate has led us to apply it over the new arising spaces beyond the Nation-State. The objective of this article is to analyse briefly the present state of the question as well as to raise current debates such as the prospect of an effective realization of the constitutional principles at a global scale; the obstacles to constitutionalise regional spaces (especially the European Union as a paradigmatic and advanced example); the situation of the democracy; and the risks for the own constitutionalism as a theoretical concept.
