摘要：

This paper will analyze the environment as a fundamental right by it's main characteristics enshrined in the article 225 of the Federal Constitution of 1988. Moreover, in the same way, comments will be made about the existential minimum in order to demonstrate their close relationship with the right to a balanced environment, as a guarantee of the right to life and health. Finally, it will demonstrate the unenforceability of the "possible reserve" clause to an ecologically balanced environment.
