摘要：

The object of this research was the Class Action 2004.38.03.003.762-5, from the 1st Vara Federal da Subsecao Judiciaria de Uberlandia/MG, that it is conclusion for report and vote from the Second Class of the Regional Federal Court of 1ST Region, since 12.11.2013. The study consisted in the analysis, considering Niklas Luhmann's Systems Theory, of legal decisions that involved the public civil action in discussing, collected on the websites of the Supremo Tribunal Federal (STF), the Superior Tribunal de Justica (STJ), the Tribunal Regional Federal da Primeira Regiao (TRF1) and 1st Vara Federal da Subsecao Judiciaria de Uberlandia/MG. The objective of the analysis is to verify the existence of supplements, foundations that do not belong to the right, in legal argument used as the basis of decision.
