摘要
This article aims to understand the theme of vices of consent and invalidity of treaties in the light of the 1969 Vienna Convention on the Law of Treaties, separating the cases of defects of consent (the voidable cases and the only nil case) from the hypothesis of nullities of the treaties themselves. The doctrine (domestic and international) overlaps about the subject, not clarifying what interfere on the "consent" of the State to be bound by the treaty and what prejudice the "treaty" itself. In this study, we search to divide well those situations, placing each topic on its proper place.
