摘要：

The law structuring theory is a complex structure that, by uniting dogmatic elements and social elements, tries to solve the antinomy between being and ought to be. Since the theory was made about the German law, the present paperwork intends to analyze the possibility of its use in the Brazilian law system as well as to show its importance to the strengthening of the State of law and the solidification of the Brazilian Judiciary.
