The "Pre-Sal" and the Formulation of Public Policies with Oil Resources - The Dilemma of the Development of Institutions Face to Temptation of Corruption

摘要
The problem of corruption in the Brazilian Oil Corporation (Petrobras), due to recent scandals involving this company and the discovery of "pre-sal" basin asks for an urgent and objective evaluation of it and of other connected facts, including the adoption of efficient tools to avoid them in the future. Through a specialized doctrine review, an economical analysis of law is used for the verification of hypothesis which might be working as one increasing element of corruption, as what is known as "natural resources curse". Using comparative data of other countries which also have large oil reserves, but without any reflection on their economic or human development, the legal frame adopted for the "pre-sal" exploitation is evaluated, identifying some loopholes. In the end, there are some suggestions of reform against corruption which can truly collaborate and reverse all the benefits from "pre-sal" to the growing of Brazil.
