PEOPLE AND TRADITIONAL COMMUNITIES HUMAN RIGHTS AND ENVIRONMENT

This study examines the right of peoples and traditional communities in light of the 1988 ' s Constitution and the "legal rules". The analysis focuses on three categories of people and traditional communities: indigenous peoples, remnants "quilombos" communities and traditional extractive communities. It is an analysis of national environmental heritage as a fundamental right of the human person and the protection of traditional peoples and communities. The survey results emphasize the importance of standardization and regulation, based on international treaties as the Convention 169 of the International Labor Organization, considering that traditional peoples and communities make up the national environmental heritage - an ecologically balanced environment and receive protection nationally and internationally as a fundamental and human right.
