摘要
This essay departs from the profound changes that the Brazilian Civil Procedure has been facing by a clear influence of the constitutional state. Changes which began the metamorphosis of a process, until recently, strongly individualistic, Roman-canonical tradition in a remarkably objective and judicial process, typical of the Anglo-American common law, with a clear approach to "the stare decisis model" which represents in general terms the legal possibility that the future judgment is bound to declare the previous decision, given the identity of cases.
