摘要
Traditionally, consumer arbitration has been an out-of-court scheme specifically designed for consumer-to-business disputes, a procedure to solve civil disputes between consumers and traders outside Court (a kind of Alternative Dispute Resolution - ADR-) "without prejudice to administrative and judicial protection". Current Laws seem to have radically changed the meaning of that expression. So this paper deals with the new sense of it, mainly considering and focusing on the confused possibility for consumers to demand civil liability in the same administrative penalization procedure, and on their effectiveness.
