摘要
The following text discusses an issue of legal interpretation status in continental system of law. Exploring a metaphor of the interpretation as a translation, it emphasizes its creative aspect, which has been denied often in modern times. Reminding the Roman origins of contemporary continental legal systems, it uses historical arguments to accent the intrinsically inventive character of legal interpretation. © 2002 Kluwer Law International.
