摘要：

This article, through bibliographic review, jurisprudential research and employing the deductive method, investigates the classification of the postal service as a public service and its relationship with the postal privilege reserved to the State is carried out. It analyzes article 21, X, of the 1988 Constitution, identifying what the doctrine and the Supreme Federal Court understand by postal service in a strict sense. It verifies the conditions and limits for the transfer of activities carried out by the Brazilian Postal and Telegraph Company (Correios) to the private sector, through a business franchise, regulated by Law 13.966/2019.
