First time detection of a genetically modified papaya in Europe - Official complaint of a non authorized genetically modified organism within the EU

In spring 2004 following a precautionary concept of consumer protection the Bavarian enforcement authority placed emphasis on the investigation of genetically modified organisms (GMO) which do not have favourable opinions from the Community Scientific Committee(s) and which are not approved in Europe. As a result genetically modified papaya fruits were found on the market for the first time. Those fruits are not allowed to be placed on the European market. All of these fruits (trade name "Hapaya") derived from the US (Hawaii) where these are officially approved. In total 37 papayas from Brazil, Thailand, Ecuador, Ghana, and the US (Hawaii) were analysed. Ten papyays, all originating from Hawaii were tested positive for the presence of a genetically introduced resistance gene protecting against the Papaya Ringspot Virus (PRSV), whereas all other samples showed no genetic modification. Import and trade of a GMO is prohibited in Europe unless its innocuousness is declared by the European Food Safety Authority (EFSA) in the course of an admission procedure. There is no such an approval for genetically modified papaya which means that this product is not marketable in Europe. This case represents the first incidence of the detection of an non approved GMO by an enforcement laboratory. At present additional papaya fruits, juices and preserves are tested.
