DVD Copy Control Association's (DVD CCA) charging of several persons with trade secret misappropriation is discussed. It is claimed that the defendants posted DeCSS (computer program) on the internet, which enable users to bypass the content scramble system (CSS) used to protect DVD movies. It was decided by two appellate courts that computer programs, atleast in the source code form, are First-Amendment-protected speech. Trade secret law has internal limiting principles that generally suffice to avert conflicts between trade secrets and the first amendment.
