The approach based on the rights of development: genealogy and the state of the issue

RESUMELes principaux acteurs du developpement font aujourd'hui la promotion active d'une approche fondee sur les droits des populations ciblees. Or, dans quelle mesure ce paradigme permet-il de repenser le developpement? Un regard genealogique sur l'insertion du langage des droits dans le champ du developpement nous permet de retracer deux grandes conceptions contradictoires du droit (emancipatrice et conservatrice). En effet, le postulat d'egalite que contient l'enonce des droits humains n'est pas sans implications politiques : il laisse place a un langage, a des categorisations et des modes de fonctionnements qui contribuent a la permanence de relations de pouvoir inegalitaires dans l'univers du developpement. ABSTRACTThe principal development actors today actively promote a rights-based approach in their relations with target populations. Yet, to what extent does this paradigm allow us to rethink development? A genealogical perspective on the inclusion of the language of rights in the field of development reveals two contradicting conceptions of law, emancipatory and conservative. Indeed, the premise of equality that is contained in the affirmation of human rights is not without political implications: it creates room for language, categorisations and operating modes that help perpetuate unequal power relations in the developing world.
