The current Brazilian social security system presupposes certain requirements to be fulfilled by the insured for the granting of benefits in kind. These requirements in some of them, presuppose a distinction of gender, being common that they are different if the beneficiary is male or female. However, the gender dichotomy on which such legal requirements are based, can no longer afford to contemplate the complexity of life, especially with respect to gender and sexual diversity. With this in mind, it is essential that the legal requirements for granting benefits be reviewed. Among the several questions that are presented, one of the most controversial is the transgender question that, born and registered in a particular genre, adopts another throughout life. In this case, will it be treated by the pension system based on the requirements imposed on the birth or social registry? Faced with legal silence on issues such as this, one possibility is that the insured is treated proportionately to the time of contribution in either gender, at least until legislation and the
