摘要：

Punitive damages is additional damages in excess of the actual damages. Punitive damages have been commonly adopted by the courts of common law applicable to tort, contract and product quality cases. Punitive damages system can make up for deficiencies of general damages. Reasonable and appropriate level of punitive damages can effectively curb the the accident t caused by the intentional or negligent conduct in the coal production. Punitive damages has an important theoretical and practical significance. in China's mine safety.
