摘要
The information, photos, preferences and geolocations that we voluntarily upload to social networks today creates a digital profile that can condition our work, economic and social future. More and more people are trying to erase this information, but in Argentina there are few regulatory details and only a few jurisprudential definitions of what has been called the "right to be forgotten" and which may collide with other rights such as information, freedom of expression and contractual clauses. In this article we will analyze the main doctrinal, regulatory and jurisprudential sutudies, beginning with a conceptual development of the most prominent authors in our country and we will continue with European regulations, a reference in the matter that will serve as a parameter to delineate this right. Then we will stop on the Argentine regulations to finish studying two rulings of the Argentine Supreme Court of Justice. As we will highlight in the Conclusions, there is a notorious regulatory gap that affects the conceptualization of this right and its limited scope.
