摘要：

In this article, we will analyse the concept of the Rule of Law within the European Union, the current challenges that are occurring in several of its Member States and the mechanisms that the EU has to protect the Rule of Law. After that, we will analyse the European Commission's proposal to conditionate EU funds to the commitment to the Rule of Law in the Member States, along with the risks inherent to this method, the position of the European institutions and the details of its processing, to obtain conclusions referring to its suitability for the current necessities of the European Union.
