摘要
The Modern Constitutionalism, developed along the lines of the Nation-State and the Cartesian-mechanistic scientific paradigm, no longer matches the current reality, global and complex. In view of this panorama, the study is about the Post-Modern Constitutionalism, a new way of dealing with the relations between Law, State, Constitution and human rights, facing the following problem: in what way can Postmodern Constitutionalism, with its transdisciplinary and open normativity, contribute to the development of International Human Rights Law? Its general objective is to expose the possibilities so that, in a post-modern constitutional epistemology, the networked legal system absorbs internationally recognized human rights. Its specific objectives are: (a) to present the limits of Modern Constitutionalism in the face of the absorption of human rights recognized at the international level; (b) to introduce the reflexes of the postmodern context in Constitutionalism and in the formation of a Global State; and (c) to explain the new legal epistemology based on the transdisciplinarity between Constitutional Law, International Law and Human Rights. Using a bibliographic technique and a qualitative approach, it deals with closely related issues, such as the transition from the Cartesian-mechanistic scientific paradigm to the scientific paradigm of complexity-reflexivity, Active-Responsive State and global governance.
