This paper aims to analyze the problem of democratic objection to the control of constitutionality from the proposals coming from deliberative democracy and dialogical constitutionalism and answer the following questions: what are the main characteristics of the so-called dialogical judicial activism? How does dialogic judicial activism seek to overcome democratic objection?
