Big Data, algorithms and artificial intelligence in Public Administration: reflections for its use in a democratic environment

This paper analyzes the impact of administrative decisions grounded on algorithms from Big Data managed by the Public Administration. A mapping will be made of the potentialities and challenges inherent to the use of non-human decision-making processes by the Government. It will be possible to identify some perplexities that may arise from the mismatch between technological advance and the theoretical instrument already available to the administrative law scholars. In this scenario, we will try to problematize some issues related to the contours that will be attributed to administrative discretion in cases where public decision-making occurs by means of algorithms. The methodology will be bibliographic, descriptive and will investigate the decision-making process based on large databases used by the Public Administration.
