摘要：

The construction industry has high incidence of industrial accident, and now has formed the layers of the subcontract of the conventional operation mode. In this model, the relationship between subcontractors, contractors and construction workers is complex and difficult to define. Due to the lack of clearly stipulates in China's current legislation for the construction industry workers compensation for damage caused by work, the labor relations and employment relation each sticks to its own view in the judicial practice. Workers' legitimate rights and interests are seriously infringed. This paper attempts to eliminate false and retain true and accurately define the relationship between the three, and explore the most favorable compensation scheme for workers on this basis.
