摘要：
The article examines the State of Siege and the Brazilian State of Defense. At first, it analyzes the background, refers to variants in comparative law, and evaluates the war against terrorism in more recent circumstances. Next, it studies the subject in the face of Brazilian law. Thus, in conclusion, it emphasizes that the nature of the mechanisms in question requires strictly episodic use, otherwise the eventual trivialization or vulgarization of the exception will undermine the logic of the Brazilian fundamental rights and the liberal democracy itself.
