Is it possible to disable the data processing agent? An analysis in light of the General Data Protection Law

This article has the general objective of researching the disqualification or disregard of treatment agents in the context of certain joint treatment operations. It aims to answer the following research question: in which cases of joint treatment is it possible to disqualify the treatment agent? The work briefly discusses the processing agents as established in the "Lei Geral de Protecao de Dados" (LGPD) in comparison with the European General Data Protection Regulation (GDPR) and other relevant regulations. The hypotheses of disqualification of the processing agent provided for in the LGPD are studied, proceeding with the hermeneutics of the respective normative statements. Considering the absence of hermeneutic criteria in Brazil, the criteria set out in the European Data Protection Agency are considered. Dogmatic, theoretical and qualitative empirical methodologies are used. The article offers a detailed explanation of what should be considered valid hypotheses for the disqualification of the controller and the operator, based on the strict legality of the main legislation influencing the LGPD.
