The translation from Arabic into Spanish and the exequatur on divorce

摘要
The objective of this investigation is to explore the typology of divorce in the laws of various Muslim countries and the difficulties of their translation to Spanish. The corpus we analyze corresponds to legal and judicial texts drawn from Arabic judicial texts, especially those of Morocco. These are concrete texts in which appear multiple terms to refer to what in Spanish is referred to simply as divorce. This multitude of Arabic terms is based on a specific conceptualization of divorce and the particular implications of each instance of these terms. The asymetries with respect to Spanish civil law are obvious. This frequently obliges the translator to undetake an educational task concerning concepts and principles that transcend his conceptual and terminological skill to translate a legal text from one language to another. The cultural and traditional importance depends, as is usual in law, on these specifications.
