摘要：

This article studies the legal regime of the right to digital disconnection from a techno-labor sphere. The objective is to capture the evolution of the concept, addressing a prior analysis of the European and national main judicial pronouncements that leads us to a detailed study of the content of this "new" right in the Organic Law on Data Protection and guarantee of digital rights (LOPD). Furthermore, and before making a critical assessment in this regard, we will highlight the impact that COVID-19 has caused on the fundamental rights of the worker by implementing this modality, in a social context of confinement as the only remedy for the spread of the virus. from remote work.
