How brazilian law faces the greenwashing?

摘要
This article seeks to demonstrate how greenwashing may be ruled by the Brazilian law. Through a qualitative, descriptive and exploratory approach, the text examines the interplay of environmental communication and the law, especially on the spheres of civil, criminal and administrative liability. For that purpose, an interdisciplinary literature mapping was performed, accompanied by content analysis in the databases of the CAPES Periodical Portal, followed by documentary survey and jurisprudence research, analyzed using the technique of legal hermeneutics. The findings confirmed that although greenwashing is subject to the Brazilian law, the judiciary have for the most part considered that the disclosure of misleading information about environmental responsibility of companies to be subject to control only when this violates the rights of consumers.
