WATER PROTECTION IN THE PERSPECTIVE OF INTERNATIONAL LAW AND THE CONSOLIDATION OF ITS ACCESS AS A UNIVERSAL HUMAN RIGHT

Water is an asset essential to life though often is not easy to access by the population. The present study analyzes the water's protection, it's legal nature and the way to access the resource. The United Nations as a fundamental human right has recognized access to water; however, the present documents are soft law, without imperative force. The importance of the resource became the access to water to fundamental right of sixth dimension, considered a universal right, deserving protection in the legal order. In this sense, we discuss the importance of incorporating access to water in international instruments with imperative force, in order to guarantee its access as a human right.
