EVALUATION OF LEGAL AID SERVICE QUALITY OF RURAL ENVIRONMENTAL POLLUTION CASES FROM THE PERSPECTIVE OF PUBLIC INTEREST LITIGATION

摘要
The current public interest litigation system for environmental protection cases in China is flawed and incomplete, there are a few problems with it such as individuals, groups, private enterprises, public institutions, lawyers, and law firms generally lack the enthusiasm to participate in environmental protection-related public interest litigations, and the lawyers assigned by the government or the law firms do not match the lawsuits. The existing relevant studies do not have a clear definition of the scope of legal aid service for rural environmental pollution cases, and there are few quantitative evaluation methods. To fill in such research gap, this study researched the evaluation of legal aid service quality of rural environmental pollution cases from the perspective of public interest litigation. At first, this paper classified the torts related to rural environmental pollution, and clarified the scope of legal aid service for rural environmental pollution cases; then, the paper constructed a legal aid service quality Evaluation indicator system (EIS) for rural environmental pollution cases with 6 first-level indicators, including legal service quality, legal service fee, legal service time, legal service reliability, legal service matching degree, and legal service credibility; moreover, this paper also gave the quantitative calculation methods for related indicators, and used experimental results to prove the effectiveness of the proposed EIS.
