摘要
This essay address the evolution of today's human rights since its genesis until the most current theories on the subject. It is relevant to outline human rights studies through its own literature, since the area is sometimes accommodated in other branches of law as if it were not autonomous. This essay was developed through descriptive qualitative research based on literature review. The genesis of human rights can be observed from different historical perspectives, but there would be a certain literature consensus on the connection between the Enlightenment, modern jusnaturalism and human rights as they are called today, as well as on the framework for the consolidation of such rights in the post-World War II era, with the Universal Declaration of Human Rights. After that moment, there was an expansion of human rights literature, influencing international law and the creation of international humanitarian organizations. Although there is disagreement about its western bias, the contemporary scholarship would defend the dialogue between cultures, since they all deal with notions, even if different ones, of human dignity. It would also affirm respect for diversity is the core of human rights, and that such respect could create adequate conditions for celebrating a culture of human rights. In light of this, it is expected to contribute to other researches that focus, for example, on the different stages of the development of human rights, as well as on its different conceptions in non-western cultures. In this way, the importance of this scholarship would be reaffirmed, contributing to a comprehensive concept about what human rights represent in a global conception.
