摘要
After characterizing the "constitutional rule of law" states and the process of constitutionalization of legal systems in the Ibero-American sphere, the author discusses three difficulties (the counter-majoritarian one, the critique to viewing rights as principles, and the problem of judicial activism) that show the inability of part of the internal legal culture to assume the requirements of a constitutional rule of law. Consequently, the author considers it is urgent to build a legal constitutionalism: a theory of law adapted to the new institutional framework.
