摘要
This paper strives to prove the statement that law in the West and in Islam tells a history. At first, the tradition of French constitutionalism is analyzed which tells much about a history of European democracy. In the second chapter, the paper considers Irish and Polish law which tell about a moral course of Europe. The third chapter of the paper considers Strasbourg case law which reflects the state of freedom of conscience in Europe. With the fourth chapter, the paper turns attention to the Islamic tradition to discuss the history that an Islamic legal doctrine can tell us. The fifth chapter discusses Tunisian law which reflects the course of democracy in that region after the Arab spring. In the end, some conclusions are delivered.
