An Analysis on Imperfection of Employment Relationship Established in Labor Contract

In this thesis, the imperfection of labor relation established in labor contract is analyzed from the perspective of property economics; firstly, it demonstrates that labor contract is a contract of human capital property right transaction and then interprets that property rights defmition of human capital is incomplete during the conclusion of labor contract because the cost for human capital property right transaction cannot be zero; meanwhile, the objective transaction cost hinders the complete defmition of property right fundamentally and the subjective transaction cost brings obstacles to property rights definition.
