摘要：

By referring to foreign legislative examples, this paper first analyzes the connotation of food infringement and punitive damages, then it analyzes the problems generated in the application of punitive damages system in real life. Furthermore, it suggests to introduce punitive damages system in food infringement field and puts forwards advice to improve the system based on the current legislative situation in China.
