CHILDREN AND ADOLESCENT RIGHTS AND THEIR APPLICABILITY: WHAT DO THE LAWS SAY?

This research aimed to analyze the applicability of the fundamental rights of children and adolescents, considering that it is the duty of the State, the family and society to ensure the defense of these rights, as provided in art. 227 of the Federal Constitution, guaranteeing children and adolescents access to the rights regulated by the 1988 Constitution, Statute of children and adolescents (Law 8.069/90), Universal Declaration of Human Rights and Convention on the Rights of the Child (Dec no 99,710/90). This study is justified and relevant because despite the existing legislation in Brazil, one of the most advanced in the world with regard to the full protection of the fundamental rights of children and adolescents, which is observed in practice, does not correspond to the normative plan. Data analysis showed that despite all these documents in the law guaranteeing these rights, in practice they need to be better implemented.
