This article examines the "rule against retroactivity", its codification in Article 28 of the Vienna Convention on the Law of Treaties, and the application of investment treaties to events before the treaties entered into force. In particular, the article focuses on the application of the rule to events before the treaties entered into force, but after the entry into force of the obligation that is alleged to be breached.
