The multilevel nature is translated into the harmonization of Community legal acts with similar legal effect within the jurisdiction of the European Union. In Spain, legal disputes, on the implementation of these legal acts, may end up being allocated to the Constitutional Tribunal as autonomous infringement of the right to judicial protection. The entitlement to judicial protection encompasses both citizens and public institutions. The rules of control "reasoned decision", "legally sound decision" and the "right to due process", as opposed to the disapplication of the instrument without raising the matter for a preliminary ruling, operate as safeguards of the due processes guaranteed in article 24 of the Spanish Constitution.
