This article critically examines the idea of a residual obligation' upon trustees in light of the Hong Kong Court of Appeal's judgment in Zhang Hong Li and others v DBS Bank (Hong Kong) Limited and others, the first appellate level case to decide that trustees have a residual or high-level supervisory obligation to beneficiaries, which is not ousted by an otherwise effective anti-Bartlett clause.
